Houston, we have a problem UPDATED 4X

A white 2004 Dodge Ram pick up truck with hunting decals all over it is parked at the end of Country Club Drive.  A call to 9-1-1 was placed. The officer didn't know that archery season was over. He thought that hunters could use rifles today as it is the start of rifle season. OMG!



There are two police cars there now. I sent an email to Keith McGill, commissioners, Phil Weis, and Aaron Lauth asking if we are now going to be dealing with hunters with rifles now.

To be clear, there is no archery permitted anywhere until December 26.

I sent a second email about archery season and No Hunting Signs.

The municipal archery program will not resume until December 26th on private properties and December 28th in the public properties approved for the program. In the event of a "sled-riding" snowfall over the Christmas break we will suspend use of the golf course property.

Hi Elaine,
Actually archery season is not over but if you are archery hunting now you are required to wear orange. As I stated earlier the municipal archery program will not resume until December 26th as we chose not to hunt the two weeks where you are required to wear orange.
The property at the end of country club is private property and I don't know whether the property owner has granted permission to anyone to hunt on the property or not. IF the owner has granted permission and IF they are meeting all the setback and other rules and regulations of the Game Commission then it would be legal to hunt the property.

DEER (Antlered and Antlerless) WMUs 2B, 5A, 5B, 5C and 5D: Nov. 30-Dec. 12. One antlered deer per hunting license year. An antlerless deer with each required antlerless license.
This applies for both rifle and archery. I admit it is a little confusing from their website but this was also discussed with the Wildlife Management Officer from the Game Commission when we met before beginning the program. Archers may still hunt during the 2 week rifle season but they are required to wear orange to do so.

So much for the Mt. Lebanon Bureau of Tourism

On October 5, 2015, a visiting Cambridge woman decided to take her dog for a walk. Amy Castor had no idea what she was about to walk into. A hunter had just killed four deer and was loading them into his silver Chevy Suburban parked on Thornwood. The details and photos were posted on this blog under  Four deer killed on Shady Lane UPDATED.

The media picked up this story a month later and had it under "Breaking News." Through the comments, someone was able to run the license plate (I guess) and the hunter was Aaron Gander, from Upper St. Clair. Amy was cited by Mt. Lebanon Police and again by the PA Game Commission. Mt. Lebanon gave her a $120 citation.  Days later, the PA Game Commission cited her for interfering with a hunt which carries larger fines plus jail time. John Hayes wrote about it on November 18, 2015.

Amy's hearing is coming up this Thursday, December 3 at 8:00 AM before Blaise Larotonda. John Hayes couldn't even get the date right in his article. I don't know if Amy will have legal representation; I'm assuming that she is flying in from Boston, but I can't be sure. The hearing is public.

The news outlets have already reported Amy’s “wrongdoings.” They read the Mt. Lebanon police blotter. Of course, it was all spun against Amy, at least by the PG's John Hayes. That is why people on the side of justice need to try to set the record straight. This is about the misconduct of the MLPD. Please come to Amy's hearing. Some showing of support at the hearing and in the press would be, well, just. I abhor injustice and I have seen my share of it. We all have.

What we take for granted, someone else is praying for

I try not to take for granted how I am blessed with God, family, friends, and good health. I am thankful for you, my faithful readers. I am truly blessed.

This year, I have to add the PA Office of Open Records to the list. They have restored my faith in government. I realize that the battle has just begun, but I couldn't have gotten this far without the help of many people.

I was really worried about what John Hayes would report in the PG about the OOR's ruling to grant my appeal. In his article, State orders Mt. Lebanon to provide deer hunt details, Hayes alludes to the idea that rough waters lie ahead for me. I had an email exchange with Mr. Hayes yesterday. In my final response, I cc'ed State Rep. Dan Miller. Hayes then backed off.

I want to thank everyone who called or emailed me to congratulate me on the decision. As Karen Carpenter beautifully sang, "We've Only Just Begun." Last year, I wrote It's a Christmas miracle! when the archery program was canceled. Here's to hoping for another Christmas miracle.

I WON THE APPEAL!!!!!! UPDATED 3X

According to the PA Office of Open Records, only 20% of all appeals are granted. I beat the odds. My appeal has been granted!! Here is what I sent to the media:


Breaking News
The PA Office of Open Records has granted the appeal by Elaine Gillen on behalf of herself and all other safety-concerned Mt. Lebanon residents.

On July 30, 2015, the Request was filed seeking “[a]ll communications to and/or from municipal staff and, all communication to and/or from the commission concerning Anthony DeNicola’s archery program from June 18, 2015 to the present.” 

This decision would have prospective application to any properties that would be signed up for the anticipated day and night rifle killing slated for February 1, 2016, to be finally voted on January 23, 2016, as well as any future municipal-sanctioned hunts.

The Requester’s appeal is granted, and the Municipality is required to provide all e-mails within thirty days. This Final Determination is binding on all parties. Within thirty days of the mailing date of this Final Determination, any party may appeal to the Allegheny County Court of Common Pleas.

At the October 27, 2014 Commission Discussion Session, you, The Commission, directed J. Merlin Benner of Wildlife Specialists, to seek approval from the PA Game Commission for archery, trap and "euthanize," and sterilization. See page 14 of 16 of the November 17, 2014 Deer Management Plan.

According to the plan that the commission approved, the time has come to focus on sterilization. Sharpshooting was not in the plan, not until Coleen Vuono came on to the Commission. Residents were told that sterilization was to follow archery and trap and "euthanize." The public bought into your plan.

Commissioners, plan your work and work your plan. Both John Bendel and Dave Brumfield said during discussion sessions that you/they are opposed to sharpshooting. Don't be swayed by Coleen Vuono. Sharpshooting was never in the plan.

Shop Small Businesses on Saturday

I rarely go to South Hills Village. Recently, I discovered that we have DSW and Ulta at the SHV Annex. Who knew?  Throughout the year, you will find me either on Washington Road or at Gloria Horn Sewing Studio on Castle Shannon Blvd.  I will not pass a lemonade stand without stopping and leaving a tip. What can I say? I support small businesses whenever possible. This Saturday is a big day for small businesses, Shop Small Saturday.


I am happy to report that Eric Milliron, one of the few Mt. Lebanon staffers who is worth his weight in gold, once again arranged free on-street parking all day Saturday on Beverly Road and Washington Road. 

This year, celebrate Thanksgiving with your family, take advantage of the Black Friday sales, and most importantly support local businesses on Saturday. I'll see you Saturday.

What will happen when we don't give our addresses at Citizen Comments on Monday? UPDATED 2X

On November 15, 2015,  I filed a Right To Know asking for proof that Coleen Vuono is a bona fide resident of Ward 3, as required in the Home Rule Charter,  Article III, Section 305 Qualifications of Commissioners.

To file this Right To Know, I had to give my name and address. To speak at a commission meeting, I must provide my address showing that I am a resident of Mt. Lebanon.

I am so tired of the crap that is being thrown at me by the municipal staff and commission. Not that it will do any good, but I sent this email to Bonnie Cross, Keith McGill, Phil Weis, and Dan Miller.

This is unbelievable. I am required to give my address when I file RTKs and when I address the commission. Yet, my commissioner is not required to prove that she is a bona fide resident of Ward 3. If Coleen Vuono is not a bona fide resident of Ward 3, she cannot be a Ward 3 commissioner. I will hear on or before December 18? After the legal review, Ms. Vuono will only have two weeks left of her term.

What is really pathetic is that yesterday, Ms. Vuono's dossier was updated on the municipal website to show her new residency on Kingsberry Circle. http://mtlebanon.org/index.aspx?nid=56 A pdf is also attached showing her updated dossier.

You folks are abusing the Right To Know law. Every RTK I file now, includes an additional 30 day extension for a legal review. Unbelievable.

Mass. woman cited for harassing deer hunter in Mt. Lebanon

I am so mad that I am shaking! This is breaking news? John Hayes is a pig. This happened almost two months ago and not as he has described. Greg Perri slept on the floor in front of his daughter's bedroom doors? Seriously? The hunter felt threatened? So that is why he contacted the PG?  OMG. These are the archery photos the police wanted Amy to delete.

As a resident of Mt. Lebanon, I have been watching this archery thing spin out of control. In the past two weeks, I have seen so many hunters in my community that I am wondering if they turned it into the State Gamelands. In addition, there are camouflage ATVs being used to chase deer as well. Last Saturday, I saw the ATVs on Cochran Road turning onto Cedar Boulevard. If that doesn’t pose a safety risk, I don’t know what does.

Two days ago, I went for a walk, and I have to mention, I have not gone for a walk since the archery started Sept. 19. Along Cedar Boulevard, there was a blood trail on the sidewalk that stretched from the Mt. Lebanon Recreation Center all the way to Bird Park Drive on Cedar. Certainly if I saw this, kids on the way home from school saw it as well. The spatters of blood were about two-feet apart and went for about a mile, which would be consistent with a wounded deer running for its life.

I also have been hearing reports of people hunting at night, and on Sunday. I myself heard gunshots on the Friday night before Halloween, which woke me up. There is a paranoia that is developing among residents – people are afraid to leave their homes, afraid of what they might see, and with good reason.

At the Nov. 9 commissioner’s meeting, they indicated that they don’t know how many deer were in Mt. Lebanon to start with (and they are unwilling to do an aerial survey). They don’t know how many have been killed (they claim they won’t know that until January), and they don’t know how many archers, authorized or unauthorized, are in our community. Why isn’t anyone monitoring this? Just about every resident I have spoken to has said that they do not see any deer anymore. How can this be allowed to happen?

Lets be clear on this – this is not hunting. It’s a downright slaughter of tame animals. What type of person can stand there and shoot a deer that is looking right at them, not running away – entire families of deer, fawns. To cause them pain and terror is reprehensible.

Timmy opposes elimination of Act 1 Index

When Corbett was in office, the School Board couldn't wait to get rid of him. In the words of Commissioner Dave Brumfield, "Corbett sucks!" Wolf was the answer to their prayers. Now, not so much.

School Board President Larry Lebowitz and our illustrious superintendent sent a letter to Governor Tom Wolf expressing their opposition to the elimination of the Act 1 Index. In the PG's Mt. Lebanon School District opposes elimination of Act 1 Index, elimination of the Act 1 Index would mean that school districts would have to put a referendum on the ballot for any and all property tax increases.
Act 1 went into effect in 2006 and allows school districts to apply to increase taxes for expenses such as pension payments and special education to a pre-set index based on wage inflation. Currently, a referendum is not needed for the increases as long as they don’t exceed the district’s index. 
Larry thinks that is a bad idea. Programs would have to be cut. He wants us to write letters to our legislators. Uh, no, Larry. This gal will not be doing that. We don't like the huge raises that administrators have been giving themselves. Eliminating the Act 1 Index would kill Jan Klein's fake budget that she submits in the winter months. (I think it is in February.) She took advantage of all the exceptions and frankly, cooked the books. I think it is long overdue. I wrote about it in June 2011, A Referendum for School District Taxes? Mt. Lebanon has been abusing Act 1 since its beginning. I hope Act 1 Index is eliminated.

Caught in a lie again UPDATED 4X

Coleen Vuono is quite a piece of work. She has submitted her THIRD statement of financial interests, and all say different things.

When serving on a board or authority, staff, or commission or running on the ballot for commission, a statement of financial interests must be filed. I asked about submitting one since I was a write -in candidate, but was told that only if I would win. I had submitted a SFI when I was on the ballot in 2011. Since Coleen was on the Parking Board, she had submitted this one. Steve Feller made a note to use it when she was appointed as a commissioner, a no-no.

When this discrepancy was uncovered, a Right To Know was filed which resulted in Coleen filing a second SFI. Of course, a nasty email from Coleen was issued to the requestor.

Noticing that her Stage 2 Sell business was not listed, a complaint was filed with the Ethics Commission. That resulted in a third version submitted by Coleen. Today, a new SFI was sent from the Ethics Commission.

Still uneasy about Coleen's eligibility as Ward 3 commissioner, I sent this to her, copied the commission, interim manager Keith McGill, and Solicitor Phil Weis:

Coleen,

I have attached several of your statements of financial interests. Does Mt. Lebanon have your latest and greatest that came from the Ethics Commission? I wanted to make sure that the municipality had your most recent SFI. I am to assume that the one that came from the Ethics Commission would be the most accurate.

Would you mind proving that you are still living in Ward 3? With the moving truck outside of 31 Woodland this past week, your dossier posted on the municipal website shows your residence as Woodland Drive. Since you have a history of submitting SFI that vary from month to month, I do not know what to believe. What street have you moved to? And will you please see to it that your dossier is updated on the municipal website?

Update November 15, 2015 11:25 AM March 2014 Stage 2 Sell ad in mtl Magazine and asking again for information as to residency requirements. I filed a Right To Know asking for proof of Coleen Vuono's Ward 3 residency.

Update November 15, 2015 6:54 PM 31 Woodland was sold on Friday, November 13, 2015 for $375,000. It is 46 days until January 1. Coleen's term ends on December 31, 2015. If Coleen turns in her resignation tomorrow, the commission will not have to find a replacement for her. As of today, there are 45 days until December 31, 2015. Section 309 of the Home Rule Charter (http://mtlebanon.org/DocumentCenter/Home/View/3860) states that the commission must fill the vacancy within 45 days after the vacancy occurs.

Celebrate Rat Amnesty Day

At 5:30 tonight, the commission will be discussing Public Works and Recreation Departments line items in the 2016 Manager's Recommended Budget. During Tuesday's Budget Public Hearing, I asked specifically about Rat Control and Deer "Management."

Mt. Lebanon has decided to stop baiting for rats. They are taking a nonlethal approach by educating residents as to how to coexist with rats. Upon further investigation, Public Works has come to the conclusion that bird feeders are a contributing factor of rat infestation. Will our commissioners be banning bird feeders next? Since rat/car collisions are at an all time low and rat complaints are nonexistent with the majority of our commissioners, our commission has eliminated rat baiting from our budget.

Additional line items to be discussed tonight are the three line items for deer "management," totaling $100,000. There will be a carryover of $30,000 from 2015, which will give commissioners $130,000 to play with for deer management in 2016. For the record, Dave Brumfield will not spend $5,000 for an aerial survey to determine how many surviving deer are in Mt. Lebanon, after 4.5 months of archery.

Fall in Mt. Lebanon

Blood-stained leaves, bags of entrails at Public Works - ahhhhh, just another beautiful fall day in Mt. Lebanon.

A Lebo Citizens reader drove by Public Works today and personally witnessed a dead deer with its legs up in the air next to the dumpster on a blue tarp behind a red SUV and 2 hunters with beards, standing next to it giving him the eye as he drove by both ways. The hunters, one in a red suv parked right next to the dumpster and another in a dark gray Tacoma using the far dumpster to dispose of deer entrails. Unfortunately, he did not have a camera with him.
