Too many unknowns UPDATED

We, including commissioners, don't know how many deer were killed last night. Channel 4 news reported today that they had taken 3 deer in the first 4 days of the cull. That tells me that no deer were killed last night.

We don't know if the McNeilly site violates a PA State mandated 150 yard safety buffer zone.*

We don't know if the commission realizes that the amended Game Commission permit allows semi-automatic rifles in .223 calliber to be used in these corrals/death traps. See page 2, condition 6.

Does the McNeilly Park site violate a PA State mandated 150 yard safety buffer zone?

This is based on the information provided by an individual on Lebo Citizens Blog who said:

"...there is a state mandated 150 yard safety buffer zone. Mt. Lebanon applied for and received a special permit to suspend this buffer zone in Mt. Lebanon. However, that permit does not suspend that state mandated safety buffer zone in adjacent communities. So while the killing corral located in McNeilly Park is in Mt. Lebanon, it is only 300 ft. behind the CITGO and less that far from homes on Donaldon and Highridge Dr. in Baldwin Township. This is in violation of their 150 yard safety buffer zone. WS were able to shoot next to your house, because that did not violate any adjacent communities safety zone. Just because they are killing deer by bait and shoot and not hunting does not automatically suspend this safety zone. It's the special permit that suspends it. And this special permit does not apply to adjacent communities home owners rights. Only they can give permission to violate their 150 yard safety zone, as long as it doesn't impact their neighbors 150 safety zone. Anyway, that's how I interpret the special permit and safety zones. I'm not a lawyer; however, if I'm correct, then the McNeilly Park killing corral is illegal, because Mt. Lebanon did not get the permission from homeowners within this safety zone on Donaldon and Highridge Dr. in Baldwin Township to violate their safety buffer zone, and this violation should be reported to the Pa Game Commission...

Dear Mr. ____ Your email (March 11 @ 8:43 p.m.) to the Mt. Lebanon Commission (and others) was referred to me for response. I'm not exactly sure what you are asking, but I will attempt to explain some of the relative benefits, in the context of the current deer culling operation, to using the semi-auto rifle and .223 ammunition.

As you stated in your email, the March 9th amendment to the PA Game Commission did approve the use of semi-auto rifles in .223 caliber ammunition. And, as you implied in your reference to the relative difficulty associated with shooting six deer with a bolt action rifle compared to a semi-auto, the benefit of the semi-auto is the quick reload of multiple rounds. Thus, the deer can be shot rapidly, hopefully avoiding or mitigating any "panic" on the part of (up to) six deer within a corral when shooting commences.

In regard to your characterization of the "use of military style assault weapons" to kill the deer, the weapons used by Wildlife Specialists have no 3 round burst and/or automatic fire capabilities like military models of the AR-15/M-16/M-4 family. The .223 caliber 55 grain hollow point ammunition has the benefit of expending much of its energy and of breaking up on impact. Testing has shown that the .223 ammo has less penetration than either rifled shotgun slugs or .40 Cal. S&W handgun ammunition. These are some of the reasons so many police agencies, including the Mt. Lebanon Police, have transitioned to the use of M-4 patrol rifles in place of shotguns with rifled slugs and/or buckshot; the use of .223 ammo is deemed relatively safer in an urban environment, given the increased accuracy and the ammunition characteristics noted above.

I cannot comment on your assertion that the Commissioners stated that the contractors would be using bolt action rifles to shoot the deer. I don't recall such a comment, though I can't unequivocally say it did not occur. At one point during the various discussions it may have been noted that if the Game Commission did NOT approve the use of semi-autos, the contractors only option would have be to use bolt-action rifles. But please don't hold me to that recollection, as the lack of a photographic memory is just one of my many faults.

  3. They know it now. I received a response from Chief McDonough who was responding at the request of the commisioners.

    I'll post later but it sounds like they knew it all along. I got half truths about a small caliber rifle.

    I didn't think it through because I never imagined any group of rational people, in this (supposedly) enlightened society, would use a weapon like that on baited, trapped animals.

    I'd like to say that this situation has hit rock bottom but I get the feeling it will get worse before it gets better.

    I will reiterate: how can we as a community go from a controlled archery hunt to mass slaughter with an assault rifle. We couldn't get archery permits but the game commission OKs this plan.

    I'm currently beside myself. It's just that appalling to me...

  4. What we do know from this video is that Northern Kentucky treats its deer a lot better than Mt. Lebanon does (well OK, good luck finding somewhere that treats them worse I suppose). THIS IS NOT TIOGA COUNTY!!

  6. 4:17 with all due respect, Mt. Lebanon elected the commissioners which signed off on this. Mt. Lebanon is home to the myopic flower mafia that started this.

    Not everyone in Tioga County is as ignorant and unprincipled as Merlin Benner.

    There are good and bad people everywhere. Let's focus on putting people with integrity and ethics in charge of Mt. Lebanon, and tossing out those who are morally bankrupt. That will go a long way to avoiding a repeat of this mess.

  10. 6:07. Please clarify what Republicans or Democrats have to do with this. Benner may be a Republican and we know the commissioners pushing this are Democrats. The one thing they share is contempt for animals, and I'd say that their psychological issues are the problem, not their party affiliations.

  11. Protesters need to be on Beadling at the beginning and end of the Markham school day. Let the Markham mommies explain to their children why deer are being trapped and shot in the head in the park next to their schools.

    Also, I've got to say the thing that shocks my kids keep commenting that if this were happening in the town where we live now the HS and MS kids would have protests, Facebook pages against this, and speak at the Commission meetings. What the heck is wrong with the kids there? Probably too worried about being PK (popular kids)? Do they really have no moral fiber? No conscience?

    I have just learned that our parks are suffering some degree of despoil age from the activities of Benner and his gang, and I'm now wondering two things: 1- WHAT is Benner going to do to mitigate against the damage of his activities in order to return our parks to us in their original conditions, once he's done with this slaughter and is on his way out of town with our money; and 2- WHY didn't the All-Wise, All-Knowing Quartet who visited this upon us require the posting of some type of bond to guarantee park reclamation? Not only will our parks be tainted with our knowledge of the barbaric acts committed there, but they're also going to remain scarred as a permanent monument to this horror? Seriously?????

    Maybe we should get some groups of folks together for a few nature walks this week end to see for ourselves...

    6:23 For those who do not know baiting animals, trapping animals and using semi-automatic weapons are STRICTLY forbidden by the PAGC.

    Which begs the question; How can they turn the municipality down for the archery permits then turn around and sign off a permit for this slaughter?

  14. Does anyone remember Benner advising the commissioners to discern why the 42% drop in MTL deer from 2013 to 2014 surveys.
    He has a drone and is doing it for a NJ community we are told here.
    He didn't say... let's see if your feeding ban is working! Let's see if the deer are moving onto greener pastures.
    Nope it was all, you have too many deer (I don't know how many exactly but I know it's too many) and I'm just the guy to get rid of them for you at $500 a pop.
    Amazing how convenient that worked out for him and that no other company cared to bid.

  15. McNeilly is clearly posted NO HUNTING TRAPPING OR SHOOTING.
    See Title 34:
    § 2508. Protection of institutions, parks and resorts.
    (a) General rule.--Subject to the posting requirements of subsection (b), it is unlawful for any person to hunt for or take any game or wildlife or to discharge a firearm or bow of any description into or upon any of the following areas:
    (2) The lands, waters or premises of any park or resort set aside for the use of the public where people may congregate in the open for health, recreation or pleasure.
    (b) Posting boundaries.--The boundaries of the lands, waters or premises set forth in subsection (a) shall be clearly defined by appropriate posters or markers calling attention to the fact that the land or water within the boundary has been set apart for the specific purpose for which it was intended and that hunting upon or shooting on the property is prohibited. No privileges shall be granted by those owning or operating the
    posted lands or waters to any other person to hunt for any game or wildlife upon the property; nor shall the person or persons owning or in charge of the lands be eligible to hunt for any game or wildlife on the lands or waters.
    (c) Exceptions.--Subsection (a) shall not apply to:
    (1) Any properly constructed and designated pistol, rifle, shotgun or archery range upon the lands of a hospital, sanatorium, park, resort or other institution.
    (2) Any part of the lands of any hospital, sanatorium,
    park, resort or institution which lie outside of the posted areas and are open to the public for hunting.
    (d) Penalty.--A violation of this section is a summary offense of the fourth degree.

    The police and game commission need to prosecute the Mt. Lebanon offenders to the fullest extent of the law. There are no exceptions.

IMPORTANT - maybe tonight I was going into market district at village square and a man that looked exactly like the picture posted of Brenner was parking in the handicap spot right across from me. Driving a dark burgundy Chevy Avalanche truck (newer) with a coved bed to the truck part. This was at 7pm. He was dressed in what looked to be hunting type clothes(camouflage) it had a pa plate but I did not get the number (no pen) I looked in every aisle in the store did not find him so I suppose he went into the cafe. I was sooooo prepared to confront him!! When I left 30 minutes later he was gone. Anyone see this truck around sites??

    On a positive note, the deer in my yard are more interested in the exposed grasses than corn tonight. Times a ticking away Benner. Green in the woods not in your wallet!

    Benner knows there isn't 150 deer in Mt Lebanon. This is simply a away to sell his BS to cities in New Jersey and beyond. Mt Lebanon is being used and abused. This event should increase his YouTube viewers by at least 3%.

Yes, people are all different and yet the same on some issues...but i think for the majority of people living in Tioga County, hunting, fishing and the great outdoors are important parts of their lives..

  22. I haven't spoken with a child who isn't horrified by the deer cull. They are taught in school not to challenge authority in any way, shape or form. It's very difficult for some of these children to even ask questions in classes. These kids think there are snipers in their parks and that they are corralling the deer because there are "too many". They have the wide eyed impression that "Mt Lebanon doesn't like deer". They are scared and confused, and some want to move.

You surely know a professional killer from the hills can be a trusted servant to the Mt Lebanon establishment. You surely know Mr. Benner can handle a firearm way safer than any other Mt Lebanon citizen. You surely know Mr. Benner or the like could never commit a crime or have an accident with his weapon of choice.

    Where the hell does one acquire the "do as I please card" to violate laws and regulations previously established by legitimate bodies for the welfare of society just to shoot deer. As you can see the laws on the books are to keep the sheeple in the pen.

    Elaine, thanks for forwarding this McNeilly site legality question. However, maybe it's me, but the response still has me wondering and shaking my head. These are the questions I'm still asking myself after reviewing that thread.

    Is the response that Chief Coleman forwarded from Scott Tomlinson, PGC Law Enforcement Supervisor, a direct response to the McNeilly site question posed, or an earlier general response regarding safety zones in Mt. Lebanon?

    The response from Scott Tomlinson has no date on it, and it doesn't refer to McNeilly Park, or the safety zone violation of residents in Baldwin Township, or other adjacent communities.

    We know that the special permit suspends the mandated safety zones in Mt. Lebanon, which is basically what that response confirms; however, the question regarding the McNeilly corral site is does the special permit suspend the mandated safety zones protecting residents in Baldwin Township or any other adjacent communities?

    It just doesn't make sense that Mt. Lebanon's special permit would suspend the mandated safety zones protecting residents in Baldwin Township, who aren't even aware that shooting is happening a couple hundred feet behind their homes.

    Based on the response given, I'm not sure that the McNeilly corral site question was being addressed. Like I said, maybe it's just me.

  27. Pro-kill Petition ?

    Has anyone ever seen the verbiage on, is it Marilyn Narey's, petition? I initially thought I had heard that the petition being circulated said something like just reducing the deer population, and that it didn't specify a lethal or non-lethal methodology, i.e. bait and shoot killing program, sterilization, or contraception, etc. If so, then residents signing it were not saying that they wanted the Commissioners to bring lethal weapons, rifle shooters or bow hunters, into Mt. Lebanon. Or did the petition say that they wanted the Commission to implement a bait and shoot culling program with rifles? In addition, could there be more than one petition out there being used with different verbiage on it. I'm just wondering, because I don't know anyone in Mt. Lebanon who has actually seen or signed this petition.

  28. 9:36, what's even more disturbing is that because of the special permit and the way the law is written, technically Benner and his minions could place a corral 1 foot from the property line of the residents on Highridge, in McNeilly Park and those residents have absolutely no say whatsoever.

    Please please tell me that the use of high-powered rifles is forbidden in the motion they passed to allow this cull. Please?

  31. This following text from a letter to the Post Gazette (linked below) may answer your question 9:52, regarding the Pro-Cull petition.

    The author writes: "Some of us went door to door in our Mt. Lebanon neighborhoods last fall asking for signatures on a petition for the commissioners to take action to reduce the population. 
    A consistent, wide majority — around 85 to 88 percent — of people throughout the neighborhoods canvassed wanted the commissioners to act."

    Make note of the phraseology-- "for commissioners to take action to reduce the population."

    They don't write-- to reduce the population [by corralling and killing.] Or by shooting in parks. Or by catch and transport. Or by sterilization. Or by tighter feeding ban enforcement.

    It just says for the commissioners to take "some unspecified" action to reduce the deer population.

    It would be interesting to see how many people would sign a petition today supporting the now known Benner plan to corral & kill deer.

    You can be sure they won't poll the community on that one!

  37. 10:06. The term "high-powered" rifle is not specific, although commonly used to instill fear by media types. There are generally more distinct differences between "small-bore" or "small-caliber" and "large-caliber" rifles, with the bore diameter of the rifle which defines this ranging from roughly .24" to .30" Larger caliber weapons shoot bigger bullets. (Simplification, but you get the idea)

    There are also distinctions between firearms based on how the bullet is fired. These reside in where the primer is located and are:

    1) rimfire, which are small caliber firearms with small and slow bullets

    2) centerfire, which can be large or small bullets, and slow to very fast.

    There are specific laws on using rimfire vs. centerfire rifles on deer and specific laws on where each may be used.

  38. Chief McDonough and AR-15 Assault Rifles

    I feel so much safer now knowing that Chief McDonough doesn't seem to have any concerns with 5 men running around Mt. Lebanon, dressed in camouflage, shooting AR-15 semi-automatic assault rifles. I obviously say that with sarcasm; i.e. I have absolutely NO faith what so ever in Chief McDonough's judgment any more. He also thinks that bow hunting in Mt. Lebanon's parks while open to the public and children isn't a safety concern. McDonough's mission in life seems to be to turn our densely populated community into a private hunting club for himself, his police officers, and the municipal staff, and into an AR-15 assault rifle shooting gallery. Under Chief McDonough's brief stewardship he has destroyed 30 years of excellent police/community relations established by our past Chief Tom Ogden. I think it's time, once the new Commissioners come on board, to send Chief McDonough packing. I think he's forgotten that our tax dollars pay his salary, and that he works for the residents of Mt. Lebanon.

Utterly ridiculous, the deer will already be in a total panic by the time the killers get there from the fact of being trapped, and even more so as they sense humans approaching.   40. 11:32 with respect to the Chief's response on using AR's, the letter is generally accurate. I'd like to know what specific "55gr HP" ammunition is being used. Without knowing that, am unable to address claims of fragmentation, frangibility, and so on.

    Do I want someone using an AR in my residential area unless life and limb are at risk? Hell NO.

    Parks and golf courses are not rifle ranges with backstops. The negligence is mind-boggling.

  41. The Deer Incidents Report

    The Mt. Lebo deer incident report is nothing more than an intentional propaganda tool to justify the slaughter of deer in the eyes of the public. What is a deer incident - anything. If one person calls the police because they saw a limping deer, that would count as an incident. If another person calls about the same deer, that is counted as a separate incident. There is no attempt to eliminate duplication among reports. The deer poop lady calls about seeing a fly on deer poop - an incident. People who call just because they see a deer is an incident. The pro-kill residents are told to call as often as possible to ramp up the deer incident report. So what's the point. It’s all a crock of BS like every other technique used to drum up support for killing deer.

She lives up in the Upstate NY area, and is a good friend of a good friend of mine from the area. BTW, she wrote a great book about her dad, "As I Knew Him: My Dad, Rod Serling", that was recently published, just in case you're a Rod Serling fan.

    Anne was active in the opposition to a similar deer killing program in her community, and she said that her dad would have been on the front lines fighting the good fight too. In addition, Ann Druyan, Carl Sagan's wife, a novelist and film producer, was also on the front lines fighting the good fight against the same deer killing program. They live in the same town. Ann Druyan went on Jane Velez-Mitchell's TV show to talk about her passionate opposition to the deer killing program in her community.

    Anyway, I could definately see Rod Serling writing a black and white Twilight Zone episode on Mt. Lebanon. All the lying, manipulating, cold hearted, wealthy, country club ladies, who sit on the boards of charitable institutions in an effort to establish false respectability, and who are celebrating their victory to kill the deer find themselves transposed into the bodies of the deer that are about to be trapped and killed. Wouldn't that be perfect karma, and a great episode of the Twilight Zone. This is exactly the kind of moral story that Rod Serling loved to use for Twilight Zone episodes.

  44. Every Allegheny County PD I am aware of has officers use their service handguns to dispatch injured deer, not their long guns, including AR-15's

    Ask the chief how many injured deer his department has dispatched using their patrol M4's (AR-15's)

    As for deer trapped in cages reacting to people, they sure as hell don't hold still for a "precision shot" no matter what the firearm.

    Benner is using corrals designed for hogs, not deer.

    Chef McDonough, if you are not being shown actual videos of this corral shooting, and not demanding to see proof of the supposed safety of this operation, you are not doing your job to PROTECT the citizens of Mt. Lebanon.

  45. 8:25 the hog corral traps being (mis)used to shoot deer are apparently made in Columbus, Georgia by a company called Jager Pro. (706-718-9789)

    Perhaps you can forward this to your friends, hunters and non-hunters alike, and ask them what they think about using Georgia-made hog corrals to trap and shoot deer.

    I saw the petition. It definitely did NOT say what method of deer control would be used. It was very vague so there is no wonder why so many people signed it. It just requested the commission to address the deer issue.
