About those non-municipal funds...

To bring any new Lebo Citizen readers up to speed, Mt. Lebanon commissioners made an agreement with the Sports Advisory Board concerning the funding of the toxic turf at Wildcat and Middle Fields. 75% municipal funds and 25% non-municipal funds. The financial proposal was never put in writing in any commission minutes. It was stated in the mtl Magazine article, field fundraising underway, that the non-municipal share would be $250,000, not 25% of the project as originally proposed. Donations were held by the Mt. Lebanon Community Endowment for a small fee. The identity of the donors were never made public.

Earlier this week, Mayor Peduto came under fire when anonymous donations were made on a recent episode of "Undercover Boss."  'Boss' gifts to Pittsburgh employees from Peduto raise questions
“They should disclose the donors to reassure the public that (donors) won't end up getting grants and contracts based on their benevolence.
We know that Gateway Engineers made out well by donating at least $4,000 to the turf project. That's for another post. Stay tuned.

Peduto promises to disclose identities of "Undercover Boss" donors 
Barry Kauffman, executive director of Pennsylvania Common Cause, said Peduto is obligated to share the information in the interest of transparency. Even though the money is coming from private donors, it's being funneled through a public agency.
Lebo Citizen readers were made aware of missing Mt. Lebanon sports organizations' 990's in these posts about 990s.  I called for better transparency. I see that I am not alone. Watchdogs call for better transparency of nonprofits' IRS filings 

So, President Elect John Bendel and Sports Advisory Board commission liaison, when are you going to share the information in the interest of transparency?

Where's Gateway?

Below is the "Account Detail Report from 04/01/14 to 07/31/14. " Why is the reporting period from April 1 to July 31? Gateway donated in 2013. How can a report be postdated? What is the final check reference number?

Update from Steve Feller

Good morning Elaine:

1) The status on the non-municipal funds is:
  • The Municipality has received a check for $92,000 and a check for $5,000 totaling $97,000
  • Mr Franklin has indicated that today by 2 pm we will have additional funds totaling $93,466 bringing the total to $190,466
  • Mr Franklin also states that a check in the amount of $50,000 will be delivered prior to the meeting bringing the total to $240,466
  • Finally, Mr. Franklin states that the Community Endowment has funds in their possession totaling $15,267 that will be delivered to the municipality by the end of the week bringing the total over $255,000  

2) Concerning the NPDSS permit, we have responded to the Conservation District's comments and expect to receive a permit by the end of the week.
3) Concerning the review of documents, the Solicitor has the right to review all documents up until the point that they are signed.
4) The draft document with the School District is attached. It has been reviewed by the School Solicitor and Supt. but has not yet been presented to the full Board.
5) We received the MSDS and related information from the low bidder
6) As Commissioner Fraasch indicated in her email to you, last night Dr. Johnson sent the Commissioners comments on this matter.

No toxicologist at Field "Enhancements" forum UPDATED

I asked the commissioners if they were able to get a toxicologist to speak at Thursday's Turf, I mean Field Enhancements educational forum and the answer was No. John Bendel and Kelly Fraasch got into it about that. Kelly said that the whole purpose of the meeting was to have a toxicologist speak about the safety of artificial turf. It turns out that they contacted someone as late as yesterday and he was unable to attend. Charlotte Stephenson spoke later and offered to bring a toxicologist. John wanted to vet the expert before permitting him to speak. Kristen piped up to say that they don't want anyone from Mt. Lebanon because they could be biased. You see, a Mt. Lebanon toxicologist could think the turf is perfectly safe, but is opposed to the cost. One resident thought that it was because there were no toxicologists who are in favor of artificial turf. John Bendel was getting snarky with me about the expert from Penn State, Dr. Andrew McNitt. What he failed to mention was that Andy has a partnership with FieldTurf, the artificial turf company whose VP of Global Marketing in Montreal was attacking me yesterday. I never heard back from Mr. Gill, by the way.

There is no conduit going in at Middle and Wildcat Fields, according to Bend it With Bendel. Funny, that is what is in the bid documents. There are no other phases, according to Bendel. John did send me this late this afternoon:

The commitments by the Sports Associations are as follows:

Soccer: $50,000
Baseball: $40,000
Lacrosse: $20,000 (lacrosse parents another $28,000 on their own and sent to the Endowment)
Softball: $7,500
Football: $6,500
Field Hockey: $1,000

The summary of contributions is attached. For some reason, I can read it with no problems on my iPad, but on my Mac laptop, it is junked up. Just a heads up. The title of the document is:

Yes, the June 12 meeting will be video recorded.

The Commission established that the non municipal funds be in hand before we award the contract, not when we accept the bids. The emails from David Donnellan and me confirm that. As far as the $5,000 from a corporate donor that will be available in December, the Commission will need to decide if we are willing to make an exception to the cash in hand requirement for a firm commitment for a relatively small amount.

The contributions made to the Endowment were primarily made by individuals. I do not believe the Endowment would release the names of contributors nor do I think they should. Moreover, I don't know why it matters who the individuals are that donated to the project. 

I am aware of the concern regarding surface temperatures on turf. Our speaker, Andy McNitt, will address this issue at the June 12 meeting.

Please explain why the words "artificial turf" are never used in any of the LeboALERTS, or any other municipal announcements such as what is on the municipal website.



I would also like to confirm with you that the non-municipal funds (cash in hand) will be released to the municipality prior to the bid being accepted. Here is the email exchange. that you had with Dave Franklin and David Donnellan clarifying Dave Franklin's statement.Also, the $5000 being donated in December should not be considered as cash in hand. 


At the SAB meeting last week, Pam Scott asked about contributions made to the turf project. Dave Franklin asked Pam to specify which contributions by asking "Private?" She said yes. Who are the corporate sponsors and /or public donors and how much are their contributions?

During the SAB meeting, Kimberly Schevtchuk was on the defensive before she could even speak. She tried to share her research with the SAB but was fired questions from all angles. Many were the same questions that were asked of her previously. One of the issues that came up at the SAB meeting was turf temperatures. Update June 11, 2014 1:09 AM I lied. I'm still up. A WTAE camera person (gender neutral, thank you) was filming residents during Citizen Comments. I wish I had taken a picture of the commissioners. They were white as ghosts. They had no idea what was going on. Are they doing a story on the Newcomers' Tax or are they going to write about how the community is getting screwed over the MWC turf project? We will know for sure in July. :)

"Leboleaks" Funding

I am trying to get as much of this uploaded as I can before tonight's meeting, since commissioners are learning about this stuff right along with everyone else.

On January 1, 2014, John Bendel emailed Dave Franklin and Tim White about a funding strategy for the turf project. He asked if either considered asking for a grant from the Mt. Lebanon Community Endowment (MLCE). I don't know anything about grants, but I thought I would share John Bendel's idea here.

The second email exchange is interesting (to me, at least). Dave Franklin wrote to Audrey (MLCE) about a proposed Project Fund Agreement. This agreement is one of the missing documents from my RTK. I copied the Office of Open Records (OOR) appeals officer, as instructed, when I sent my long list of missing documents to Steve Feller. In Franklin's note, he stated that the municipality will send a request for funds AFTER awarding the project. Donnellan clarified Franklin's statement by saying that the funds are needed PRIOR to awarding the project. John Bendel confirmed it. So there it is in writing, Folks.

Municipality and (MTLSD?) raising non-municipal funds in corporate deal UPDATED

According to Minutes of the November 25, 2013 Adjourned Meeting of the Mt. Lebanon Commission, the Commission allocated $750,000 in municipal funds for the turf project, including $637,400 by action at the November 25, 2013 meeting. The remaining $112,600 will be considered in a separate motion at a future Commission meeting. In this month's issue of our municipal mtl Magazine, there is a three page article about field fundraising. The Public Information Office writes that the field sports organizations are to raise an additional $250,000 or 25% of the project. Volunteers are to contact Dave Franklin at his office, dfranklin@eckertseamans.com according to the municipal magazine article. But look who is doing the heavy lifting raising non-municipal funds.

As revealed in my January 24, 2014 Right To Know, the Sports Advisory Board (SAB) or field sports associations, isn't doing the lion's share of raising non-municipal funds. It is the Municipality!  Gateway, our municipal engineer has donated $4,000 in 2013, with promises of more in 2014. Gateway is also doing the engineering on the project and any traffic studies required; however, a major portion of the dollars required will have to come elsewhere. What I discovered is a sweetheart deal with...drum roll please...Dick's Sporting Goods. Orchestrating what should be something entirely by the private sector are Mt. Lebanon Commissioners, the Director of Recreation, MTLSD Athletic Director, and the Municipal Engineer creating the pathway for the SAB and the Turf Project Task Force (TPTF). 

Keep in mind that the RTK information requested was from November 1, 2013 to January 24, 2014. 

Steve Silverman, elected but not yet sworn in as Commissioner, started communicating with Tony Lombardo, V.P. of Dick's Sporting Goods (DSG) on December 5, 2013. Steve indicates, "I am hopeful Dick's will help Mt. Lebanon with our new Turf Field." 

On December 11, 2013, Steve followed up with Tony and brought Commissioner John Bendel, and Director of Recreation David Donnellan into the conversation. Steve suggested that Tony meets with the three of them.

A question arises as to what Dick's might do for the turf project and how Dick's would benefit is addressed in the December 19, 2013 email from David Donnellan to several SAB members, including Municipal Engineer Dan Deiseroth of Gateway, and MTLSD Athletic Director John Grogan. Click here --->THIS IS A VERY SIGNIFICANT EMAIL. <----- Is the School District aware of Grogan's involvement with this partnership? Does it conflict with Policy KGD Partnerships and Sponsorships? Why is Mr. Grogan involved with any fundraising project of this magnitude while MTLSD is trying to raise $6 million?

The December 20, 2013 emails indicated that Chip Dalesandro, representing Football, didn't like the deal. Donnellan thanked Silverman for reassuring Chip that no such commitment had been made. [Yet.] Silverman, using his mtlebanon.org address, is now aware and involved.

Donnellan copies Commissioner John Bendel on his December 19, 2013 message about Dick's, so Bendel is involved.

Mr. Lombardo indicated on December 20, 2013 his looking forward "to helping in any way.." and a meeting with his V.P. of Community Marketing on January 6, 2014  in a reply to a Donnellan message of December 19, 2013

The holidays slowed things down for a while until we find that another Dick's executive, Jim Famularo is contacted by Commissioner Silverman, and cc's Bendel and Donnellan about a meeting scheduled for January 30th when all will be present.

January 17th and 18th emails describe meetings and the very revealing Tim White message of January 18 at 9:48 AM sent to John Bendel, which states that "While they (Dick's) can stroke a check for a huge position on this, my understanding was they wanted some type of access to our constituency (defined as sports groups grant them access to email lists) and they want a contract for blanket procurement for sports products" found here. The "blanket procurement for sports products is still on after all. Bendel and Silverman are parties to this as well

So here we have it. The Municipality is doing the major "private fundraising" and a Municipal part time employee, Katherine Heart, doing fundraising for the "private" funding as well, as I revealed in Big enough for its own post UPDATED. Why isn't the Municipality working toward raising its balance of $112,600?

This stinks. It has been kept entirely out of the public knowledge. 

Meanwhile, this appeared in Pittsburgh Business Times on March 7, 2014. Dick's Sporting Goods launches campaign to fund youth sports "Every year we’re seeing more and more cutbacks in sports,” said Gruden in a prepared statement. “Budgets are being decreased, coaches are being eliminated, and fewer players are going out for youth sports. We have to do something about it!”

Update March 9, 2014 3:13 PM I scanned turf vendor correspondence and wish that my RTK was later than January 24, 2014. The responses to the turf vendor questions were either sent after the cut off date or they are MIA. I have also scanned the Field Analysis completed by Jordan Halter in May 2012.
