An open letter from Charlotte Stephenson UPDATED

Time for a New Chapter!

To friends of all party affiliations who helped with my campaign, thank you! To the few voters who considered the person rather than the party and responded to my invitation to “interview” me and make an informed choice, kudos to you! From recycling questions to property taxes we had important dialogue. I ran for office to understand our needs and potentially serve our residents to the best of my ability. In spite of my outreach efforts, as one of our witty community members says “Don’t confuse me with the facts, my mind is already made up!”

According to the Allegheny County Elections Bureau report, 72.86% of Democrats and 26.14% of Republicans voted the straight party line. (I believe this is county-wide, no data on municipal voting.)
According to the data I received in the spring, there were 37% Republican and 51% Democrat registered voters in Ward 2. This probably changed over the past several months since people move, change party affiliations and register. Election results showed that I received 31.4% and my opponent received 68.6% of the votes.

Competition in elections is important. Unfortunately, here in Mt. Lebanon there is no real competition other than within the Democrat Committee, and there will not be any anytime soon. Yes, the local Republican Committee has been completely ineffective for some time and I attempted to change that, but our predominantly Democrat community would not shift if the RCML arose from the ashes and worked to recruit Republican registrations until the cows came home. 

When a stand up guy like Bob Fischer can’t get elected it’s clear that we have lost our way putting party labels above what is best for our community. By the way, to those who are criticizing Bob for not publicizing his opponent’s indiscretions, why didn’t you chip in and send a letter? Elaine’s blog brought candidate Grella’s citations to light but that didn’t matter, so how would Bob’s stooping have made a difference? Could you have? I don’t believe so.

 “Our nation’s political environment has fueled hatred at local levels and we have not been immune. But the true test of resilience is how a community handles such challenges, and the residents of Mt. Lebanon have proved time and time again what real community is all about. Last year, we came together in an open forum – in the extreme cold – to denounce hate and violence in all its forms, and to show our children that love and acceptance trumps exclusion and bigotry.” 

So what about our stellar firefighter citizen who stood out in the freezing cold all day on Tuesday? Was his loss due to exclusion or bigotry? I’ll call it exclusion. The elimination of Bob’s potential leadership on the Commission was truly a disservice to our community, so to the Democrat Committee of Mt. Lebanon, shame on you! You are so drunk with power that winning an election is more important than electing winning leadership for our community. You have sold out. Lebo prides itself on celebrating diversity and welcomes everyone? – yep.

Now, it’s my turn. I am not a political statistician. Obviously, far less than the number of registered Republican voters came out and supported me. Have they given up? A thousand Republican phone banks times the Democrat Committee of Mt. Lebanon’s actual amount could never have produced the necessary number of votes for me to win. I do not blame the Republican Committee for that. My race wasn’t even close.

Additionally, Republican “pro-artificial turf on Cedar Blvd.” voters supported my opponent since he is pro-artificial turf. Republican David Franklin lobbied against me on Facebook because I opposed the installation of artificial turf. He praised my opponent’s community service record and support of artificial turf. Well done, Dave. My outstanding community service record wasn’t worth mentioning, huh? To the residents on Vee Lynn, you may want to invest in the special blinds that completely block out light when the $500,000.00+ lighting goes in. Don’t forget to purchase earplugs for the additional traffic from the 50+ added parking spaces and the loudspeaker amplifying day and night. As you are lying in bed with a pillow over your head remember, Mt. Lebanon is a community that cares!

To those who won’t support anyone unless they are a “D”, I have been a life-long Republican and registered to vote when Jimmy Carter was in office. At that time we were in a recession, gas lines/rationing and unaffordable interest rates (21%), inflation (18%),  70% marginal tax rates, and 11% unemployment limited our way of life. My father was out of work for most of my high school years due to the recession and his age. I watched him type letters every day for two years to find a job. He was a World War II vet who completed his degree at Pitt on the G.I. bill while working at J&L Steel. To this day I have remained a Republican because that is where I started. I think there are good apples and bad in every political party. My roots result from my personal experience, something that I hold dear. Can you respect that?

In many ways, I am more “Democrat” than my opponent was in the areas of environment and keeping taxes affordable to maintain diversity here – economic, racial and intergenerational. On Election Day, I chatted with an environmental activist who thought adding artificial turf to Mt. Lebanon was the best decision. Huh??

In February, I attended a “Ready to Run” workshop at the Pennsylvania Center for Women and Politics at Chatham University, of which a Mt. Lebanon woman and past Commissioner is a sponsor. However, this individual is listed on my opponent’s website as a “Friend” (supporter) and offered me nothing, zippo, zilch as I ran for office. So, I guess the hypocritical center will promote women in politics – as long as they are a D. I can hardly wait until the next Mt. Lebanon diversity celebration!

This campaign has had many peaks and valleys. Peaks, hands down, were watching my opponent’s sign being removed from a lawn once the property owner took the time to know the facts, and the positive feedback from others. Valleys were being thrown under the bus because of my friendship with Kelly Fraasch, voters’ snarky questions about how I voted in the last presidential election on their way into the polls, and seeing that some people are so entrenched in their political leanings they feel it’s OK to be rude. One neighbor said that anyone in this day who is a Republican is…..(readers can fill in that blank). I am so feeling that diversity vibe, how about you?

So, what’s next? I am pleased to have recently been elected to a talented board for a fantastic organization in Pittsburgh. That may sound like sour grapes, but it is actually true. I look forward to working with our county treasurer and other dedicated members who only want what is best for our Pittsburgh community and the organization. I’ve hitched my wagon to that star and I will also continue to work on local projects that matter to me with people who have stood by me – R’s and D’s. So, this R is not going away.

As for Mt. Lebanon politics, C’est la vie! The voters will be rewarded according to their choices. As you have sown you really will reap. I can’t wait to see how this turns out.

To quote Will Rodgers: On account of being a democracy and run by the people, we are the only nation in the world that has to keep a government four years, no matter what it does.”

9:23 I probably will not banter too much in the blog because it’s not an even playing field when people will not identify themselves. We all know that sitting at a keyboard anonymously often exacerbates poor behavior since there is no accountability involved. However, you asked an important question and I would like to respond.

In my letter, I stated “Yes, the local Republican Committee has been completely ineffective for some time…”

So, to answer your question “What did the LeboGOP do in this election to convince voters- R, D or I that it was the vehicle or had the drivers to get us on a road to successful, principled government?”

Answer - nothing.

Do I think that Democrat Mt. Lebanon voters will listen and shift their support to Republican candidates if the LeboGOP works to show them the Republican Tenants in action? – Nope.

Regarding the “Republican pro-artificial turf on Cedar Blvd.” voters running things around here as you stated, I was pointing out that Republicans throw other Republicans under the bus to protect their special interests as in the case of David Franklin. His Facebook post stated:

 “In WARD 2, please support incumbent STEVE SILVERMAN for COMMISSIONER.  Steve was a strong advocate IN FAVOR of the field renovation project on Cedar Blvd and has always been very helpful on other issues involving our parks and recreation facilities.  

His opponent lobbied against the installation of the new fields on Cedar.”

Regardless of communicating Republican tenants in action, I do not think any anti-artificial turf candidate would get anywhere with that lobby.

I believe we have an imbalance of representation due to our organizational structure. I would like to see the Sports Advisory Board be reorganized as part of a “Recreation Board”. When you look at the budget allocation for recreation and recreational facilities it really doesn’t make sense to only have representation from sports. The new Board should include residents with varied interests e.g. sports, swimming, skating, walking trails, dog park, fitness enthusiasts, etc. so there would be diversity.

Since I will not be posting after this, I would like to share some of the comments that I have received from others:

lost out on a hard working commissioner.”

-“ Thank you for sending this heartfelt letter.  I hadn’t known you long before the election and I pegged you as a class act; someone totally authentic and dedicated.”

-“ Mt. Lebanon has lost two dedicated public servants and will pay the price. So sad.”


Finally, yes, if Elaine had not posted the information about the Century of Excellence Campaign we never would have known of the school district funding and subsequent unsuccessful result. She is Mt. Lebanon’s investigative reporter!

Mt. Lebanon is on a roll UPDATED 2X

Now that Mt. Lebanon has learned to appeal the PA Office of Open Records' final determinations, they are on to ignoring the PA State Ethics Commission requirements.

Besides not permitting residents to copy Statements of Financial Interests, besides ignoring the five day requirement to respond to Right To Know requests, besides accepting deficient statements of financial interests, and collecting those statements after the mandatory deadline of May 1, we now see how some are permitted to skip submitting those statements entirely. Included are some from those on the Hospital Board, the Pension Board, the Planning Board, the Library Board, the Zoning Board, Board of Appeals, Mt. Lebanon Civil Service Board, and the Economic Development Council. Not all members submitted their SFI, as required. Then there is the Sports Advisory Board, including Mr. and Mrs. Franklin [encouraged the commissioners to take me to court over the archery RTK] and Chip "He Who Shall Not Be Named" Dalesandro [see Bullied again], who arranged for $250,000 in donations and got the commission to spend over $750,000 for artificial turf, as well as the Historic Preservation Board, who spent $25,000 on a Virginia Manor remodeling guide. A member of the Historic Preservation Board frequently writes for mtl Magazine and gets compensated $25 per article as a "volunteer" blogger. She submitted this and will receive a $25 check for writing it.

The Allegheny County website indicates the owner name is VUONO FAMILY 2008 IRREVOCABLE PENNSYLVANIA REAL ESTATE TRUST. Coleen also stages homes for real estate agents with Howard Hanna.   • Kelly Fraasch resides at 53 Academy Avenue. She works for Howard Hanna. See Coleen Vuono.  Oops, Coleen!
Historically, Steve Feller would make pdfs and email statements of financial interests at no charge in a timely fashion, no questions asked. I am slowly updating my blog to include past published posts. Mt. Lebanon will do as they want, when they want. The rules never apply to them. Now you know why Bonnie Cross stalled when asked for SFI. They were still coming in as late as May 12, 2016. But Mt. Lebanon is not held accountable. There is a new sheriff in town and our commissioners are asleep at the switch.

The Municipality is the location where the State required Statements are filed.  To help facilitate filing, we will typically send the required form to the relevant personnel.  We also have sent reminders on occasion.  We generally do not verify the accuracy of the forms, as we do not believe we are required to do so under State law.
As far as who needs to file, that is set forth in the Ethics Act.  I will add that the one area where questions seem to arise is with our various boards.  The Ethics Act exempts members of advisory boards that have no authority to expend public funds and who cannot exercise the power of the Municipality.  This exemption encompasses many of our boards, as they do function in an advisory capacity only, and cannot expend Municipal funds.

Back to public

Lebo Citizens has reverted back to being a public blog, putting the hundreds of posts that were published since going private, in draft form. The comments have been preserved, and I can go back to private status again at any time and the comments will not be lost. Members will not have to sign up again since Blogger keeps the list.

It has been almost a year since Lebo Citizens went private. I published a few posts that were from that period. Quite a bit has transpired since then. Of course, 219 deer were killed. All of "my" deer were killed. I haven't seen any deer since March. I won two appeals with the Office of Open Records, and because of that, Mt. Lebanon has decided to take me to court.

Encouraging the commissioners to take me to court were Cori Vipperman and Dave Franklin. Ms. Vipperman's libelous statements include threatening phone calls occurred, harassment, and threats made to families. Ironically, Ms. Vipperman speaks of harassment for daring to disagree. Reading the comments in any newspaper article pertaining to the killing of deer illustrates the maliciousness that anti-deer killing folks have had to endure for "daring to disagree."

Dave Franklin's letter to the commissioners, encouraging them to take me to court is available here. Mr. Franklin has spent an enormous amount of time checking the Lebo Citizens website from work since he sent that email.  The closer to the time to read the judge's decision, the more frequent the visits. Dave, it should be any time now. Talk about cyberbullying, you're one of the best.

Thanks for encouraging the commissioners to take legal action against me, causing me to hire an attorney at the cost of $4,000. I do have some friends who were able to contribute $2,000 toward the expense. I am truly grateful for them.

I want to report that the commissioners do not respond to any of my emails. Right To Knows are virtually denied every time. They put me through the wringer on other issues. I have had unwelcome visitors at my door. All because I dare to disagree.

Oh, I am back to not accepting anonymous comments.

Is this payback over the turf project?

Dave Franklin wrote to John Bendel and Dave Brumfield, to ask for their support in moving forward with the appeal. The one in which the Office of Open Records ruled in my favor.

Dave had blamed me for the delay of the toxic turf project, when in reality, the delay was because of Gateway's blunders.

I guess payback is a bitch.

Sports Advisory Board November meeting minutes finally posted

On Monday, I wrote to the commission asking about the SAB meeting minutes being posted. At that time, the June 2014 meeting minutes were the most recent ones available. I received this response from President John Bendel:
Elaine,
Meeting minutes are posted after they are approved. Therefore, the postings have at least a one month delay. In the case of the SAB, they met on June 14, November 6 and January 15. The November 6 minutes were approved a few days ago at the January 15 meeting. They should be posted shortly.  
Maybe the questions to Mr. Bendel should be, "Why does the board with the largest budget ever recorded in Mt Lebanon history have gaps of over five months between meetings? If the board's needs are so essential, why the long vacation?"

Mr. Franklin suggested that the policy be adjusted to reflect any changes to the field signage ordinance. He added that he doesn’t anticipate a great deal of interest from corporate sponsors.
In April 2012, Lebo Fields' Dave Franklin had insisted that we must change the sign ordinance.  Franklin on sign ordinance
Ideally, the municipality or the various sports associations will be permitted to sell tasteful sponsorship signage at the municipal fields (picture signs on the outfield fence at Dixon). These funds can then be applied to field maintenance and improvements. I think the first proposed amendment has a few problems, but we also need to encourage the commissioners to stay focused on getting the amendment right so that we can capitalize on this much needed source of additional revenue.
The Sports Advisory Board met again on january 15, 2015. At approximately the 32:19 minute mark of the video, Dave Franklin was blaming the delay of the construction on those who wanted to stop the project. All it did, according to Dave, was cost the municipality more money and "it was much ado about nothing." Last I read, the Allegheny County Conservation District and the DEP would disagree with you, Dave. Gateway had to comply. The NPDES permit wasn't granted until October 16, 2014. Gateway told you that it would be the beginning of July. Don't blame us for it. Blame Gateway. Thanks for giving us so much credit, but we had nothing to do with it.  Our protests were on October 26, 2014 and November 8, 2014. Construction was due to start August 1 and didn't begin until late October.

By the way, SAB, I guess this is "more ado about nothing."

Rep. Steve Israel Blasts Feds for Failing to Probe Synthetic Turf
A New York congressman is demanding the feds probe whether a type of synthetic turf used on thousands of kids' playing fields could cause health risks, saying that environmental officials have "whiffle-waffled" about the potential dangers. 
Rep. Steve Israel of Long Island has sent a letter to the Environmental Protection Agency asking for a second look at the recycled material known as "tire crumb."...The EPA has said it does not have any plans to re-examine the risks.

"The EPA has just whiffle-waffled on this and they owe us a straight answer and they owe us that answer now," Israel said.

A Community With Character[s] Part 2

On the Municipal side of Mt. Lebanon government, we have five commissioners, each representing their Ward.

Lame duck President is Kristen Linfante. Kristen has taken the commission to a whole new level. Once respectable, the commission meetings have become a three ring circus with Kristen at the helm. Threats to shut down the meeting, lies, and personal attacks toward constituents and their employers are just some of Kristen's signature moves. A self-proclaimed environmentalist, Kristen is in favor of artificial turf, killing all the deer, and igniting people. My all time favorite piece from her blog, Real Lebo, is an attack toward me. My Mother Taught Me Never To Lie  Kristen wrote, "There are two things that I just can't tolerate - mean people and liars." My commissioner was projecting all the way back in 2010. She will tell you that I ran against her and lost, but she still doesn't understand that she ran unopposed in the 2011 Primary. I ran against incumbent Joe DeIuliis and lost. Kristen's term ends in 2015. Not soon enough.

President Elect John "The Refiner" Bendel ran unopposed in the 2011 commission election, after his opponent pulled out of the race. I understand John is not real popular with his constituents in Ward 1 in the area of sidewalks, traffic calming, and artificial turf. John is the commission liaison to the Sports Advisory Board and went to the SAB in October and asked them how they wanted to spend the pot of gold, otherwise known as the unassigned funds. Bend It With Bendel vetted FieldTurf partner, Dr. Andrew McNitt before the June 12 turf project presentation held at Mellon Middle School. John is seeking reelection and may not be the only Ward 1 Democrat running in the 2015 Primary.

Kelly Fraasch is my adopted commissioner. Kelly is the epitome of elected officials. She listens to constituents and tries to seek common ground with critics. A hard worker, Kelly is dedicated to serving Mt. Lebanon residents in a fair and professional manner. I don't always agree with Kelly, but she does have my utmost respect. Kelly's term ends in 2015 and I hope she seeks reelection.

Steve Silverman is the commission newbie. As commissioner elect, Steve hit the ground running with the turf project, asking for a corporate sponsorship from Dick's Sporting Goods. My late husband, account executive and on the food broker advisory board for Gatorade, would have appreciated Steve's efforts to build Gatorade sales through artificially turfing a field. Steve's term ends in 2017.

Commissioner Dave Brumfield introduced the idea of turfing Mellon Middle School Field during the February 28, 2012 Joint Discussion Session. Don't ask him the definition of "fair." Not a Dave Brumfield fan. We're stuck with Dave for two more years with his term ending in 2017.

Manager Steve Feller reports to the commissioners but manages the various departments within the municipality. He is also the Open Records Officer responsible for granting or denying Right To Know Requests by taking the full 35 days, rather than five, for legal reviews every time. Screwing up the pool bid opening, the Public Safety Building, and approving the first change order for the turf project without the commission's approval are just some of his many accomplishments.

Andrew McCreery is our new director of finance. Andrew stepped up to the plate when I asked a member of the PIO for her assistance (and was ignored) with the 102 year old resident who was being recognized. However, Moody's did downgrade our rating since he took over.

Tom Kelley is retiring soon. Tom kept Rockwood Park in great shape and declared a cease fire in Rockwood Park after many phone calls to him. I will never forget that.

Susan Morgans is the town diva. As our Public Information Officer, editor of mtl Magazine and Community Relations Board staff liaison, Susan has a unique perspective on our fine community. A 1965 Lebo graduate, Susan Fleming Stroyd Morgans feels that she owns this town. Her biggest fans, Laura Pace Lilley and Merle Jantz, report to Susan. Hide your recorders when you see Susan.

Keith McGill, our municipal planner, has been involved with the Zamagias fiasco since Day 1. Keith informed the Planning Board about the turf project, saying that there is no need for their input. According to Marcia Taylor, Keith and Steve Feller have lunch with Marcia monthly. It is nice that they keep in touch.

Gateway Engineers' Dan Deiseroth is our municipal engineer. Dan is a financial supporter of the toxic turf project and bills Mt. Lebanon for his work on the project. It's a great gig. No conflict of interest there. 

David Donnellan is our director of recreation. A dedicated employee, David built the climbing wall at the swimming pool. Concerned with loss of revenue, David wanted to keep the golf course open during the archery hunt. David also rushed the swimming pool construction in order to open on Fathers Day. A non-voting member of the Sports Advisory Board and member of the super secret Turf Project Task Force, David was instrumental in making the toxic turf project a reality.

Mt. Lebanon Police Chief Coleman McDonough took charge of the now suspended archery program. I have a lot of respect for Coleman, but question his judgment to keep the golf course open during the hunt.

Nick Sohyda is the chief of our award winning fire department. A great guy.

Eric Milliron is Mt. Lebanon's Economic Development Officer and manager of the Commercial Districts Office. There's no drama with Eric, one of Mt. Lebanon's greatest assets. 

Phil Weis is the Municipality's solicitor. I like Phil, but he has to do what he has to do. 

Marcia Taylor retired from the Municipality earlier in 2013 as assistant manager and finance director. Marcia ruled with an iron fist. Talk to her about police pensions.

The puppet masters behind this cast of characters are the following:

Barbara Logan, master gardener and former commissioner, wants deer dead in the worst way. She donated to Kristen Linfante's political campaign.

It is said that Carolyn Byham, another gardener, former commissioner and deer hater, is willing to pay for an entire deer cull. The commission should talk to her about funding the $68,000 dedicated to deer management for 2015.

Dave Franklin is legen (wait for it) dary. He likes to let everyone know that he is an attorney every chance he can. Dave's legal opinion on the safety of synthetic turf and the EPA is documented here on Lebo Citizens. Dave's dedication to the turf project fundraising is full time. Dave is a part time member of the Parks Advisory Board, but full time Parks Advisory Board Liaison to the Sports Advisory Board. He is a non-voting member of the SAB, but through his super secret Turf Project Task Force and being married to a voting SAB member, Dave gets the job done.

David Reese, one of the trolls here on Lebo Citizens, wrote a letter to the editor of the PG on 09.01.11 explaining that he is not tax averse and wants to pay higher taxes. You should have a conversation about that at your next family gathering, Dave. 

What can I say about the member of the super secret Turf Project Task Force, Chip Dalesandro, who came to my door unannounced? Not much.

I hope this Municipality Who's Who guide is helpful. I may have inadvertently left out someone, so this list may be updated. Since 2015 will be a year of change with elections for five seats for school board directors and three seats for commission, I am optimistic that the majority of our local government will be a positive change in direction for Mt. Lebanon.

Turf bids awarded UPDATED

Lots of excellent comments made by residents this evening who are against the turf project. Dave Franklin was thanking everyone for this night becoming reality. Brian Auer, another member of the Turf Project Task Force and Sports Advisory Board, doesn't understand why any corporate sponsor should be made public. This was after I asked for an accounting of corporate donors and the amounts donated. This really bothers me. Why are corporations' identities being withheld?

I noticed that President Linfante did not ask if there was anyone who did not sign the sheet to speak during Citizen Comments. She did it again after the Public Hearing closed. Thankfully, Kelly Fraasch  brought that to President Linfante's attention. Linfante reopened the Public Hearing.

OK, so here is where I go into the vote for moving unassigned funds for the turf project at Middle and Wildcat Fields. Please watch or listen to Kelly Fraasch and her reasons for voting against assigning funds to the turf project. It brought tears to my eyes. Also listen again a little later when Kelly Fraasch reads her letter to the EPA. The motion passed 4 to 1 with Kelly voting against the motion.

And now the vote for artificial turf. The motion passed 4 to 1.

Shark Tank gave a unanimous thumbs down to synthetic turf.  It’s worth watching if you attended the meeting this evening — for comfort.

Good morning Elaine:

1) The status on the non-municipal funds is:
  • The Municipality has received a check for $92,000 and a check for $5,000 totaling $97,000
  • Mr Franklin has indicated that today by 2 pm we will have additional funds totaling $93,466 bringing the total to $190,466
  • Mr Franklin also states that a check in the amount of $50,000 will be delivered prior to the meeting bringing the total to $240,466
  • Finally, Mr. Franklin states that the Community Endowment has funds in their possession totaling $15,267 that will be delivered to the municipality by the end of the week bringing the total over $255,000  

2) Concerning the NPDSS permit, we have responded to the Conservation District's comments and expect to receive a permit by the end of the week.
3) Concerning the review of documents, the Solicitor has the right to review all documents up until the point that they are signed.
4) The draft document with the School District is attached. It has been reviewed by the School Solicitor and Supt. but has not yet been presented to the full Board.
5) We received the MSDS and related information from the low bidder
6) As Commissioner Fraasch indicated in her email to you, last night Dr. Johnson sent the Commissioners comments on this matter.

Why GeoTurf and the ESB never had a chance UPDATED 2X

The lies started on November 25, 2013, when Kristen Linfante misrepresented the Environmental Sustainability Board's position on artificial turf.

No, actually it started before that. Back on November 20, 2013, Larry Evans, a retired FieldTurf guy from Mt. Lebanon contacted Kelly Fraasch and suggested that she call Penn State's Andrew McNitt for information about GeoTurf. Kelly followed up with an email to McNitt. Evans had contacted GeoTurf and said that he was a consultant to the commission. What Evans failed to disclose to Kelly was that McNitt had a partnership with FieldTurf and asking for his opinion of GeoTurf is like asking Coke their opinion of Pepsi. FieldTurf on GeoTurf Also in the email link, is an exchange that John Bendel had with the GeoTurf representative. The rep also indicated that irrigation is not needed with GeoTurf because it performs well in our climate. John seemed receptive to GeoTurf's product. But Dave Franklin was not. And we all know Dave Franklin's position on the EPA.

FieldTurf - Turf Vendor Questions page 164 "Synthetic turf poses no health risks." Yet, the National Athletic Trainers' Association (NATA) released a consensus statement GUIDELINES TO PREVENT SUDDEN DEATH IN SECONDARY SCHOOL ATHLETICS PROGRAMS In Maryland, schools canceled outdoor activities when it was 93º outside. It was too risky for athletes playing on artificial turf. 

On a side note, I found the Mt. Lebanon Community Endowment contract on pages 128-162.

On Monday's Discussion Session agenda is Dr. Phil Johnson. He will speak about the health and well-being of our populations – including pregnant persons, infants, children, those with respiratory disease including asthma, those with allergies, those with neurodisabilities or disorders; those with cancer or surviving cancer; and those at risk of developing cancer. You can read his letter to the residents of Mt. Lebanon here.
Funny how the second item on the agenda, Wildcat/Middle turf improvements, follows an update from Republic, our new trash collectors.

It's not over! Public Hearing on Unassigned Funds July 8 will be introduced at Monday's Commission meeting by John Bendel. Look at the first item on the list. Also on July 8, the funds will be allocated and the turf bid will be awarded.

Update June 22, 2014 1:10 PM A suggestion was made to me this morning. Since the public is not permitted to speak during Discussion Sessions, we should wear our "No Artificial Turf" stickers or print out this sign, I [Heart] Lebo Sports on shirts or on paper for both meetings.

Summarized findings:

(1) The studies collectively indicate (e.g., in their methods and limitations sections) that sampled fields and materials cannot be extrapolated. Findings cannot be extended beyond the particular study sites and used to reach broad conclusions with respect to other fields because these studies are not representative.

A variety of reasons contribute to this outcome, including:

a. Wide diversity of materials and ingredients in fields (studies are only specific to areas studied);
b. Diversity of construction;
c. Diversity and variability of real-world factors including ambient weatherizing (e.g., solar radiation) and wear conditions (e.g., physical activity patterns); and
d. Variation with respect to components monitored, sites sampled and samples taken.

In order to determine whether the proposed fields in Mt. Lebanon may pose a health risk to humans – and especially to our susceptible populations – decision makers and the community require (a) full and complete lists of ingredients and materials in the artificial fields (including fill and synthetic grass blades) and (b) full and complete lists of ingredients and materials to be used to maintain the artificial fields, including for example any pesticides, biocides or cleaning agents.

With this information in hand, the community and its leadership can begin a process to ascertain potential exposures and the possibility of associated adverse health effects to humans on and using the fields toward a deliberative decision-making process about whether to undertake an activity with the potential to harm public health.

Without this information, there is no way to characterize public health risk and make an informed decision because information will be incomplete, limited and subject to excess uncertainty.

Given this uncertainty, the health and well-being of our populations – including pregnant persons, infants, children, those with respiratory disease including asthma, those with allergies, those with neurodisabilities or disorders; those with cancer or surviving cancer; and those at risk of developing cancer – may be at risk.

(2) Overall, with respect to human exposures and ability to develop risk analysis, the studies collectively either report or do not mention significant methodological limitations, including:

a. As noted above, cannot extrapolate findings to other fields: the studies are acknowledged as non-representative.
b. Do not adequately quantify the potential for exposures to some susceptible human populations such as neonatal populations, persons with neurodevelopmental disorders and diseased populations;
c. Do not adequately simulate real-world exposure conditions – including sustained and diverse physical activity, as well as field disturbance (e.g., compression and degradation) under a range of conditions (e.g., field age, solar radiation) that may affect release of chemicals into the environment;
d. Do not consider multiple possible chemical exposures that field users would experience from the many possible chemical ingredients in the fields or used to maintain the fields;
e. Provide inadequate simulation of typical field use and condition factors in both core field and ambient air;
f. Do not adequately sample for worst-case exposures from newly installed fields;
g. Do not adequately address potential for chemical exposure synergies and interactive effects;
h. Do not adequately focus on possible chemicals (such as lead) in synthetic turf fibers/blades;
i. Focus only on one component of the field (such as infill crumbs), and within this subset are unable to consider diversity of such components among other fields;
j. Do not adequately consider chemicals and other materials used to maintain fields;
k. Use averaged threshold values to screen out reported measured chemical concentrations rather than full distributions including peaks – and therefore eliminate relevant data from further evaluation;
l. Have limited or no VOC and SVOC sampling;
m. Rely on air sampling techniques limited by variability of monitors, short duration sampling and staff activity interference; and
n. Recommend further study given limitations and inadequacies.

I have also uploaded the podcast to Lebo Citizens and is available here. The SAB threw residents to the wolves during Citizen Comments. There were three residents who spoke. The first resident was told that there will be no more super secret Turf Project Task Force meetings. Their work is done. Dave Franklin said that they are at $245,000. The second resident had shared her followup research with the Parks Advisory Board, which the PAB liaison Dave Franklin chose not to share with the SAB. She tried to share her research with the SAB. She instead was met with hostility. What a group. The third resident was able to get the breakdown from Franklin. The $245,000 is made up of $125,000 pledged by the Sports Associations, $93,000 in cash, and $27,000 in corporate commitments with $5,000 of that $27,000 will be paid in December.

It was announced that there will be only Dr. Andrew McNitt with no mention of a toxicologist at the June 12 meeting. This is the PIO Press Release. Do you see the words "artificial turf" ANYWHERE in the press release or on the municipal website? Nope. Not there.

Gateway is billing us $1,000 per meeting! UPDATED 4X

I am not an attorney. Everyone knows that, but I think I have pretty good instincts when something isn't right. From the Lebo Citizens post, Bullied again on April 24, 2014, two residents tried to attend the Turf Project Task Force meeting, which was held immediately after the "not for the general public" public meeting at the concession stand. They were told by members of the super secret task force that it was not a public meeting. The two residents said that they would just like to observe and took two meeting agendas. These two residents were told to return the agendas and were asked to leave. Members of this super secret turf project task force include Dave Franklin, "He Who Shall Not Be Named," MTLSD Athletic Director John Grogan, Recreation Director David Donnellan, Landscape Architect Jim Sauer from J.T. Sauer, and Municipal Engineer from Gateway, Dan Deiseroth. According to the January 9, 2014 SAB meeting minutes*, Gateway Engineering contributed $4000 for the Middle and Wildcat Turf Project.

Keep in mind, Gateway's Dan Deiseroth claimed that the fields on Cedar Blvd. never flood.



It turns out that Gateway Engineering is charging Mt. Lebanon $1,000 per Turf Project Task Force meeting. There have been seven meetings, and we have been billed $7,000.


The following is the May 2, 2014 memo that Dan Deiseroth sent to Steve Feller concerning the Turf Project Fees expended.


Something that has been overlooked for several meetings now, is the Turf Project Task Force Financial Report. John Bendel had promised to share that information a month ago. It still hasn't happened. Kelly Fraasch was kind enough to share this "report" with me this morning.

A resident told me last night that the sports associations are emptying their piggy banks to fund this project without giving notice to parents. Also, please note that there is no mention of the "largest donation made by Soccer," according to Dave Franklin. Also, I am confused as to what is the cash in hand balance.

Why is everything such a secret? Why weren't the financial reports given at the commission meetings? Why are residents being asked to leave the Turf Project Task Force? Why did Dave Brumfield freak out at the commission discussion session when Kelly Fraasch brought up the topic of residents attending the Turf Project Task Force meetings? Why is it being left up to John Bendel to decide? Why are there so many unanswered questions concerning this turf project?

I have asked the commission for a draft of the bid that is going out tomorrow, May 15. Kelly Fraasch copied me when she asked for a copy of the draft. So far, nothing.

I understand that there is a process in which taxpayers can pay their taxes in protest, with a portion of the funds going into an escrow account. This pertains to assessments. All you Mt. Lebanon attorneys who are not involved with the Sports Advisory Board, would you check to see if we can do the same with this turf project? I am not seeing overwhelming support. Residents are against it for financial reasons, environmental reasons, health and safety of our young athletes, as well as the arrogance, misrepresentation and lack of respect from our elected officials who are being dishonest every step of the way.

4:30 on a Wednesday afternoon in May w/ near perfect weather and... All fields are empty.
