In Matt Santoni's Mt. Lebanon to avoid daily reports on deer culling because of contention, is Susan denying us of our First Amendment Right? Now Benner is blaming protestors. Please explain, Mr. Benner and Mrs. Stroyd Morgans, how is protesting in front of the Municipal Building or along Connor Road interfering with or disrupting the program?

Cori Vipperman, who supports a deer management program, said she understood why municipal staff are cautious about releasing information.
“If they came out with too much information, there are some — I'm not saying all in the opposition, but some — who might use that information to sabotage the program,” Vipperman said.

Seriously, Ms. Vipperman? The three police officers who approached residents on Sunday walking by Bird Park were told there was $1500 of damage to the deer corral in Bird Park.

"Lauth said police logged no incidents or accidents, although a contractor suspected people of trying to disrupt or damage corrals. Police found no suspicious or illegal activity, Lauth said."

Second location at golf course identified UPDATED

If you are on Sleepy Hollow standing in the old Giant Eagle, the corral is across Sleepy Hollow and up on the hill. The access road is on Arch, which is Castle Shannon. GPS coordinates are coming soon below. It is an active killing site. There is a corral/trap with straw inside, netting over the top and bullet holes through the plastic. Hard to tell the trajectory, but they may be shooting uphill.

Also, the No Trespassing Zones have been expanded at the Connor Road site. I was told that this was also done at Robb Hollow.

From March 9th-March 13th Animal Control has picked up 4 dead deer, on Locust, Scott, Moreland and Birch.

Moreland is just above the corral/killing trap at Robb Hollow. I have no details as to how the deer had died.

Some changes in the amended Game Commission permit include using clover traps*, which the commission DID NOT want to use, the use of semi-automatic rifles in .223 calliber to be used in these corrals/death traps (See page 2, condition 6), and the increase from two men to five men.

It’s Nita, again. Ed and I will appreciate your supplying us with the below requested information before the end of this business day.

Steve, everyone knows that the municipality wants the public to know as few details as possible about Benner’s operations in Mt. Lebo. I have actually heard that Benner and the municipality (including the police) have suggested keeping the details quiet in the interest of SAFETY.  Whose safety?

It is absurd and illegal (for the commission, the MLPD, and the PA Game Commission) to only supply the important, relevant information to the Benner boys and other choice municipal employees. THEY HAVE THE GUNS. They can protect themselves (from what, I don’t know).

The children of Mt. Lebanon have been placed and are at high risk of harm by the very people whose jobs require them to act as the “ultimate guardian” of our children. (Phil Weis can tell you about Parens Patriae and its very strong public policy implications in PA.) 

Please comply with the below request so that the general public may have at least some information on which to base safety decisions this weekend and in the future, especially for the children. Stop keeping secrets. It only perpetuates the continual decline of Mt. Lebanon.

My interest in the ongoing Mt. Lebanon deer-kill operation is primarily public safety. At the commission meeting this past Tuesday night, the municipal manager was less than forthcoming about the locations of the corrals that are being used to lure deer, trap them and kill them with some very powerful weaponry.

Spring has sprung. Like you, Steve, I am an on-hands parent. With the ever increasing amount of daylight in mid to late March, kids of all ages will be out in droves, visiting the public parks that were once viewed as safe havens in Mt. Lebanon. They are contaminated now and may be for years to come.

For the sake of our children, please let me know today the exact location of each of Merlin Benner’s corrals.

Update March 14, 2015 7:49 AM Mackenzie Carpenter with the Pittsburgh Post-Gazette interviewed me before writing "The DeerFather," a parody based on Mt. Lebanon deer-cull, will not be in theaters soon — if ever. Her intent was to write a lighthearted article based on how social media is reacting to the deer killing. In a phone conversation, she asked me to watch Fake Lebo's video and email my thoughts about the video. Here is what I wrote to her:

March 15, 2015 6:08 AM PG's John Hayes is at it again. Mt. Lebanon deer cull begins, four killed 
According to Hayes, we have THOUSANDS of deer in Mt. Lebanon. Our commissioners have hired Wildlife Specialists to kill up to 150 deer. Mr. Hayes indicates that zero deer were killed on Night 5, with a total of four deer killed by five men, authorized by the PA Game Commission, in five nights. Hayes writes:

Now that pro-cull residents know that during deer hunting seasons they can legally waive safety zone protections and invite archers to hang tree stands on private property, some may take Mt. Lebanon deer management into their own hands.

Mt. Lebanon commissioners have hired an expert to kill 150 deer, Mr. Hayes. You have obviously been talking with Kristen Linfante, encouraging residents to take matters into their own hands.

Wildlife Specialists will continue to cull deer in five public park areas through March 31. The parks are: Bird, Robb Hollow, McNeilly, the Mt. Lebanon Golf Course and the Connor Road Conservation Area. Activity begins at 9 p.m. when the parks close and ends by sunrise. Signs are posted at parks where activities are taking place and at the actual corral sites. As of March 13, 2015 four deer were euthanized*. We will issue another report on deer management next week.

Dears for Deer

Many kids are upset by this plan to kill deer in Mt. Lebanon. I believe they should be heard as well. I am willing to post their artwork or letters, with parents' permission, of course. I would rather not have their names associated with their artwork.

This is a picture of my nine year old who wore her sticker from the protest when she went to school the day following the commissioner's meeting a few weeks ago. She told me that when she went into school wearing that sticker on her hat that a group of kids gathered around her and they started chanting "NO TO DEER KILLING!"...Yes, A group of fourth-graders! Both she and my 11-year-old ask me every morning when they wake up if I know if any more deer have been murdered. We were all thrilled this morning as we saw deer prints in the mud in our backyard and I saw one of our neighborhood deer running across the street as I walked out dog!

We, including commissioners, don't know how many deer were killed last night. Channel 4 news reported today that they had taken 3 deer in the first 4 days of the cull. That tells me that no deer were killed last night.

This is based on the information provided by an individual on Lebo Citizens Blog who said:

"...there is a state mandated 150 yard safety buffer zone. Mt. Lebanon applied for and received a special permit to suspend this buffer zone in Mt. Lebanon. However, that permit does not suspend that state mandated safety buffer zone in adjacent communities. So while the killing corral located in McNeilly Park is in Mt. Lebanon, it is only 300 ft. behind the CITGO and less that far from homes on Donaldon and Highridge Dr. in Baldwin Township. This is in violation of their 150 yard safety buffer zone. WS were able to shoot next to your house, because that did not violate any adjacent communities safety zone. Just because they are killing deer by bait and shoot and not hunting does not automatically suspend this safety zone. It's the special permit that suspends it. And this special permit does not apply to adjacent communities home owners rights. Only they can give permission to violate their 150 yard safety zone, as long as it doesn't impact their neighbors 150 safety zone. Anyway, that's how I interpret the special permit and safety zones. I'm not a lawyer; however, if I'm correct, then the McNeilly Park killing corral is illegal, because Mt. Lebanon did not get the permission from homeowners within this safety zone on Donaldon and Highridge Dr. in Baldwin Township to violate their safety buffer zone, and this violation should be reported to the Pa Game Commission...

Dear Mr. ____ Your email (March 11 @ 8:43 p.m.) to the Mt. Lebanon Commission (and others) was referred to me for response. I'm not exactly sure what you are asking, but I will attempt to explain some of the relative benefits, in the context of the current deer culling operation, to using the semi-auto rifle and .223 ammunition.

As you stated in your email, the March 9th amendment to the PA Game Commission did approve the use of semi-auto rifles in .223 caliber ammunition. And, as you implied in your reference to the relative difficulty associated with shooting six deer with a bolt action rifle compared to a semi-auto, the benefit of the semi-auto is the quick reload of multiple rounds. Thus, the deer can be shot rapidly, hopefully avoiding or mitigating any "panic" on the part of (up to) six deer within a corral when shooting commences.

In regard to your characterization of the "use of military style assault weapons" to kill the deer, the weapons used by Wildlife Specialists have no 3 round burst and/or automatic fire capabilities like military models of the AR-15/M-16/M-4 family. The .223 caliber 55 grain hollow point ammunition has the benefit of expending much of its energy and of breaking up on impact. Testing has shown that the .223 ammo has less penetration than either rifled shotgun slugs or .40 Cal. S&W handgun ammunition. These are some of the reasons so many police agencies, including the Mt. Lebanon Police, have transitioned to the use of M-4 patrol rifles in place of shotguns with rifled slugs and/or buckshot; the use of .223 ammo is deemed relatively safer in an urban environment, given the increased accuracy and the ammunition characteristics noted above.

I cannot comment on your assertion that the Commissioners stated that the contractors would be using bolt action rifles to shoot the deer. I don't recall such a comment, though I can't unequivocally say it did not occur. At one point during the various discussions it may have been noted that if the Game Commission did NOT approve the use of semi-autos, the contractors only option would have be to use bolt-action rifles. But please don't hold me to that recollection, as the lack of a photographic memory is just one of my many faults.

THREE Deer died last night UPDATED

I don't know how many yet. Three deer were killed early this morning. I am sick over this.

“Deer were killed and delivered safely to the processor,” J. Merlin Benner of Tioga County-based Wildlife Specialists LLC said in an email, declinging [sic] to provide more details.

We need to find out who the processor is. Feller said that Benner is not required to say until the culling is over. 

At the high school this morning, someone released crickets inside the school. Pretty symbolic and creative, guys!!!

I would like to reference condition six of the revised Game Commission Permit amendment approval 03/09/15. “Listed sub-permittees, acting under contract with the township may remove deer from the project area by capturing deer using baited clover traps and/or portable corral traps and subsequently shooting the deer. Listed sub-permittees may utilize SEMI AUTOMATIC RIFLES IN .223 CALIBER TO SHOOT THE DEER.  The lie the commissioners told the public was it was going to be a bolt action rifle.

No way you can kill six deer in a small pen with six bolt action shots; PERIOD!

The PGC authorized the use of MILITARY style assault weapons to cull the deer and the commissioners were OK with it.  THIS is complete BS!  I’m tired of the municipality trying to “sanitize” the slaughter. They are losing the PR war, we need to keep increasing the pressure!

Mt. Lebanon's controversial deer-culling program gets underway

At about 1 a.m., J. Merlin Benner, president of Tioga County-based Wildlife Specialists LLC, and an associate were at Robb Hollow, where their trail cameras indicated they'd had about four deer in a corral with the gate still open. But when Mt. Lebanon Police arrived to check on another reporter who was also near the park, they scared the deer off before the gate could be remotely closed, Benner said.

Mt. Lebanon deer cull may be postponed


"The start of the controversial cull of 150 white-tailed deer in Mt. Lebanon, planned for Monday night, might be delayed for technical reasons.

Brian Benner of Wildlife Specialists said today that some necessary equipment wasn’t in place.

And the company plans to request an addendum to its permit from the state Game Commission, he said, expanding the number of workers it may use during the operation.

“I’m not sure if we’ll start Monday or not. It depends on how much equipment we can set up,” said Mr. Benner. “We still have to set up some cameras and different technology that lets us know where the deer are.”

The special use permit allows only two workers to participate in the project. Increased manpower would enable the work to proceed more quickly and efficiently, said Mr. Brenner."

Lebanon deer killing sites have not been cleared yet by all of the utility companies. More calls today and especially tomorrow are necessary. People who call him for help must mention that Saturday’s P-G reported that the shooting will begin tomorrow night. Technically, all work is to stop until all of the utility companies get there. Mt. Lebanon told Merlin Benner that it wasn't necessary to call PA One Call. Mt. Lebanon also said that if anything happens, it will be on Merlin Benner. Wrong. It will be on all of us. HELP.
